The Municipality of Milos is attempting to block a second investment for the creation of a 5-star hotel on the island after the immediate cessation of construction work on a hotel complex near Sarakiniko, ordered by the General Secretary of Spatial Planning and Urban Environment of the Ministry of Environment and Energy, and a parallel review of the legality of the building permit.
In particular, the Municipal Committee, at its recent meeting, provided a special mandate and power of attorney to the Athens lawyer Mr. Vasilis Papadimitriou to represent the Municipality of Milos, in order to serve its interests, study the case, and proceed with the drafting and filing of an application for annulment before the Council of State for the annulment of the pre-approval of a permit relating to a project for the creation of a 5-star hotel as well as any other related act according to which the construction of multi-story buildings – tourist accommodation is attempted outside the plan, on the sandy beach (protected area of the Natura 2000 network) of Achivadolimni in Milos.
This is a pre-approval of a permit that was granted in December 2023 to the company ANDRONIS KALNDERA S.A. with an authorized representative, Mr. Alexandros Andronis.
Syros lawyer Ms. Maria Talasli, as legal advisor to the Municipality of Milos regarding the above case, stated that due to the exceptional nature of this procedure, its particular seriousness, its difficulty, and the fact that it is particularly important for the interests of the Municipality, the type of special knowledge it requires, requires its handling by a lawyer with specialized knowledge and experience.
The more specialized knowledge and specialized experience that the lawyer assigned to the case must possess, lie in his long-term involvement with the branches of urban and spatial planning law, but also in the branch of environmental law, as well as in his more specialized training and experience in the procedural handling of annulment cases and in particular cases before the Supreme Court of Cassation.
This procedural experience becomes essential also based on the recent amendments to Presidential Decree 18/1989 which make necessary the knowledge, familiarity, and interpretative approach to the amended legislative annulment provisions. Therefore, in this case, a decision must be taken by the Municipal Committee and a mandate must be given to a specific lawyer who possesses the necessary expertise, experience and specific scientific knowledge.
